It was written in Germany in the late 1930s and completed in the United States in 1940, where Fraenkel lived after fleeing the Nazis in 1938. The title derives from Fraenkel's thesis that National Socialism divided the law into two co-existing areas. The first of these, The Normative State, protects the legal order as expressed in statutes, decisions of courts and the activities of administrative agencies. Its counterpart is the Prerogative State, which is governed by the party. It exercised "unlimited arbitrariness and violence unchecked by any legal guarantees" (xiii). As a detailed record of what has happened to the Rechtstaat under totalitarian auspices, this book is without rival.--Fritz Morstein Marx, Harvard Law Review 54 (1940-1941), 1267 Several scholars have published authoritative descriptions of the German political and legal system. Fraenkel's book differs from its predecessors in so far as it represents, to the reviewer, the first attempt to provide a theoretical analysis of the German legal order.--Otto Kirchheimer, Political Science Quarterly, Vol. 56, No. 3 (Sep., 1941), 434-436 Ernst Fraenkel [1898-1975], the renowned political scientist, is widely considered the father of the theory of pluralism in Germany. He served in the German Army during the First World War from 1914 to 1918, worked as a labor lawyer with the left-wing political activist Franz Leopold Neumann, and as a Social Democrat and a Jew, fled Germany to the United Kingdom in 1938, and then to the United States in 1939. It is said that the manuscript of this book traveled ahead as contraband. He served as legal counsel to Korea before returning to Germany in 1951. In 1963 he founded The John F. Among the rights guaranteed by these amendments are freedom of speech, freedom of the press, freedom of religion, and the right to trial by jury. But what was this strange document and how did it gain such legendary status?

Dan Jones takes us back to the turbulent year of 1215, when, beset by foreign crises and cornered by a growing domestic rebellion, King John reluctantly agreed to fix his seal to a document that would change the course of history. At the time of its creation the Magna Carta was just a peace treaty drafted by a group of rebel barons who were tired of the king's high taxes, arbitrary justice, and endless foreign wars. The fragile peace it established would last only two months, but its principles have reverberated over the centuries.

Jones's riveting narrative follows the story of the Magna Carta's creation, its failure, and the war that subsequently engulfed England, and charts the high points in its unexpected afterlife. Reissued by King John's successors it protected the Church, banned unlawful imprisonment, and set limits to the exercise of royal power. It established the principle that taxation must be tied to representation and paved the way for the creation of Parliament.

In 1776 American patriots, inspired by that long-ago defiance, dared to pick up arms against another English king and to demand even more far-reaching rights. In The Presidential Pardon, legal scholar Saikrishna Prakash explores how this brief clause has grown into the most expansive and controversial tool of the modern presidency.

Originally intended as a mechanism of mercy--to temper harsh laws and foster reconciliation--the pardon was once used with solemnity and circumspection. Today, it has evolved into a blunt and potent political instrument. Presidents use it to shield allies, reward supporters, fulfill campaign promises, and make political statements. In January 2025, for instance, the outgoing and incoming presidents issued major pardons--one to protect relatives and allies, the other to deliver on a pledge to his electoral coalition. These actions mark a turning point: the pardon power is no longer a curious exception to politics but increasingly a feature of it. Most countries are the progeny of revolution. At the birth of this nation, the Founding Fathers faced the quintessential question of self-governance: how do you keep democracy from devolving into violent anarchy or brutal despotism? Drawing on little-known facts from the founding, Jonathan Turley reveals how the United States escaped the cycles of violence and instability that plagued other democratic movements, from ancient Athens to 19th-century France.

As the nation approaches a new era marked by artificial intelligence, robotics, and profound economic shifts, America must again withstand the pressure of radical forces that seek to curtail our natural liberties under the guise of popular reform. Politicians such as Franklin Roosevelt found ways to condemn and discard the Constitution and to redefine the Declaration to justify government without limit. As a result, both documents have been weakened, their influence diminished, and their meaning obscured--paving the way for the modern administrative state, unaccountable to the will of the people.

The Founders' Key is a powerful call to rediscover the connection between these two mighty documents, and thereby restore our political faith and revive our free institutions.

ISBN-10: 1595555765
ISBN-13: 9781595555762
Author: Arnn, Larry
Publisher: Thomas Nelson

Proudly printed in America, this beautiful gift edition contains the complete text of the United States Constitution, as well as all of its amendments.

The landmark legal document of the United States, the U.S. Constitution comprises the primary law of the Federal Government. The framers designed an American constitution to succeed where Britain's had faltered, planning for continuous population and territorial expansion that would eventually cross the continent. Yet by the end of the nineteenth century, it was already ill-suited for an increasingly urban, industrialized society, and the transformations of the twentieth century have pushed it to a breaking point. This book charts the history and aims of the American constitution from its origins in an agrarian past to the grave crisis we face today.

Mark Peterson traces the American constitutional tradition to the control of land in medieval England, showing how the founders incorporated the aspirations of Magna Carta with the administrative principles of the Domesday Book, a meticulous survey and valuation of landed property commissioned by William the Conqueror. This framework encouraged the growth of democratic self-government in a young nation. It also institutionalized the colonization of territory and the expulsion of Indigenous peoples, establishing a legal blueprint for transforming tribal lands into revenue-yielding real estate for settlers. Peterson's riveting narrative paints an arresting picture of a dynamic republic whose frame of government has changed enormously to meet the challenges of the modern age but whose written constitution has changed very little.

Marking the 250th anniversary of American independence, The Making and Breaking of the American Constitution reveals how this widening disconnect threatens the very existence of our democracy.
